Kattan and Chattah (No 2)

In the matter of Kattan and Chattah (No 2), Johnston J of the Federal Circuit Court of Australia considered applications concerning property and parenting proceedings, as well as an application for a stay. The dispute involved the father and mother, with the father indicating his intention not to appeal the court's decision.

The court was required to determine several legal issues, including the dismissal of an application filed by the father, the allocation of costs in relation to the property aspect of the substantive trial, the mother's application for costs in the parenting proceedings, and the costs associated with the stay proceedings. The court also needed to address the conveyancing arrangements for the sale of the former matrimonial home.

Johnston J ordered that the father would not be filing an appeal. The father's application filed on 30 June 2015 was dismissed. The father was ordered to pay the mother's costs for the property aspect of the substantive trial from the commencement of the hearing on 17 June 2014. The mother's application for costs in the parenting proceedings was dismissed. The father was also ordered to pay the costs of the Independent Children's Lawyer in the stay proceedings, and the mother's costs thrown away in those same proceedings. Finally, by consent, HH Conveyancing was appointed to undertake the conveyancing for the sale of the former matrimonial home.
