Katiforis and Secretary, Department of Social Services (Social services second review)

This matter concerned an appeal by Ms Katiforis against a decision by the Secretary of the Department of Social Services regarding her eligibility for a Disability Support Pension. The central dispute revolved around whether Ms Katiforis met the criteria for severe impairment due to her medical conditions, specifically Carpal Tunnel Syndrome (CTS), chronic pain, and Post-Traumatic Stress Disorder (PTSD), within a specified qualification period. The case was heard by S Taglieri SC, Member.

The legal issues before the Tribunal were whether Ms Katiforis' medical conditions, namely CTS, chronic pain, and PTSD, were fully diagnosed, treated, and stabilised within 13 weeks of her application for the pension. The Tribunal was required to determine if these conditions attracted sufficient impairment points under the Social Security (Tables for the Assessment of Work-related Impairment for Disability Support Pension) Determination 2011, and if so, whether she had demonstrated a continuing inability to work and, if necessary, participated in a program of support as mandated by the Social Security Act 1991 and the Active Participation for Disability Support Pension Determination 2014.

The Member found that while CTS, chronic pain, and PTSD were fully diagnosed, the evidence did not establish that the chronic pain and PTSD were fully treated and stabilised within the qualification period. This conclusion was based on medical reports and treatment records indicating ongoing treatment and the potential for improved function for these conditions after the relevant period. Consequently, Ms Katiforis did not satisfy the threshold for severe impairment, and therefore, the Tribunal was not satisfied that she met the eligibility requirements for the Disability Support Pension.
