Karina Fisheries Pty Ltd v Mitson

In the Federal Court of Australia, the appellants, Karina Fisheries Pty Ltd and others, appealed against the decision of a judge of this Court (O'Loughlin J) which held that warrants issued under the Crimes Act 1914 and the Proceeds of Crime Act 1987 were valid. The respondents sought leave to appeal against so much of the decision as held that the warrants issued under the Proceeds of Crime Act 1987 were invalid. The court found that the s.10 warrants were valid, and the s.71 warrants were invalid. The court dismissed both the appeal and the application for leave to appeal, and ordered that the appellants pay the respondents' costs of the appeal, and the respondents pay the appellants' costs of the respondents' appeal. The court granted liberty to either party to apply on seven days' notice.
