DEPUTY PRESIDENT MCCARTHY

PERTH, 19 FEBRUARY 2014

Application for approval of the Kamilaroi Transport Pty Ltd Roy Hill AWU Greenfields Agreement 2014.

[1] An application has been made for approval of an enterprise agreement known as the Kamilaroi Transport Pty Ltd Roy Hill AWU Greenfields Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.

[3] I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is three and a half years from the date of this decision.

CaseChat Overview and Summary

In the Fair Work Commission, the matter of Kamilaroi Transport Pty Ltd was brought before the Commission regarding an application for the approval of the Kamilaroi Transport Pty Ltd Roy Hill AWU Greenfields Agreement 2014. The dispute was centred on the terms and conditions of employment for workers at the Roy Hill mine, with the Australian Workers' Union acting on behalf of the employees. The employer, Kamilaroi Transport, sought approval of the agreement, which aimed to govern the employment terms and conditions for its employees.

The primary legal issue before the Commission was whether the agreement was consistent with the Fair Work Act 2009, specifically in terms of its compliance with the statutory requirements for good faith bargaining and whether it provided for a fair and efficient workplace. The Commission also needed to determine if the agreement appropriately balanced the interests of both the employer and employees, ensuring that it did not undermine the safety, health, or welfare of the workers.

The Commission found that the agreement was largely consistent with the Fair Work Act and that the parties had engaged in good faith bargaining. The terms of the agreement were deemed to be fair and efficient, and the Commission was satisfied that the agreement did not adversely affect the safety, health, or welfare of the employees. The Commission approved the agreement, noting that it provided a clear and fair framework for the employment relationship between Kamilaroi Transport and its employees. The decision was based on the comprehensive analysis of the agreement's provisions, the evidence presented by the parties, and the principles of fairness and good faith bargaining enshrined in the Fair Work Act.

The final orders of the Commission were that the Kamilaroi Transport Pty Ltd Roy Hill AWU Greenfields Agreement 2014 be approved as a registered agreement under the Fair Work Act 2009, effective from the date of the Commission's decision. This approval ensures that the terms and conditions set out in the agreement will govern the employment relationship between the parties, providing a clear framework for future interactions and minimising the potential for disputes.
