CaseChat Overview and Summary
The Administrative Appeals Tribunal considered an application for a Skilled (Provisional) (Class VC) visa, Subclass 485, made by Mr Kalyan. The central dispute concerned whether the applicant met the character requirements stipulated by clause 485.216(1) of Schedule 2 to the Regulations, which incorporates Public Interest Criterion (PIC) 4001.
The legal issue before the Tribunal was whether the applicant satisfied PIC 4001, which requires an applicant to pass the character test or for the Minister to be satisfied that there is nothing to indicate a failure to pass the character test, or for the Minister to decide not to refuse a visa despite suspicion or lack of satisfaction regarding the character test. Regulation 2.03AA also mandates the provision of specific documents, including a statement from an appropriate authority regarding criminal history and a completed Form 80, unless waived by the Minister.
The Tribunal reasoned that while the Department had requested an Overseas Police Clearance Certificate, which the applicant initially failed to provide, the applicant subsequently submitted an Indian Police Clearance Certificate. This certificate, issued by the Ministry of External Affairs, Government of India, indicated no adverse information that would render the applicant ineligible for immigration purposes. Consequently, the Tribunal found that the applicant satisfied the requirements of PIC 4001 and therefore met clause 485.216(1).
The Tribunal remitted the application for a Skilled (Provisional) (Class VC) visa, Subclass 485, back to the Minister for reconsideration, with the direction that the applicant meets the criteria specified in clause 485.216 of Schedule 2 to the Regulations.
