Kalla and Kalla

In the matter of *Kalla and Kalla*, Rees J of the Supreme Court of South Australia made orders concerning the property of the parties. The dispute involved the wife seeking to secure her interests in a property owned by the husband, and the husband's dealings with the proceeds of its sale.

The court was required to determine the extent to which the wife's interest in the property should be protected pending further orders, and how the proceeds of the property's sale should be distributed. Additionally, the court considered the husband's obligation to provide spousal maintenance to the wife.

Rees J ordered that the wife be permitted to lodge a caveat on the property to notify her interest. The husband was restrained from dealing with the sale proceeds other than as directed. Upon settlement, the proceeds were to be applied first to any mortgage, then to agents' commission, followed by a payment of $100,000 to the wife as partial property settlement. The remaining balance was to be held by the wife's solicitors in a controlled monies account until further order. The husband was also ordered to pay the wife $720 per week by way of spousal maintenance.
