Furthermore, the Court held that ANSCI had failed to establish the defence of equity, as they had the onus of proving the absence of practical injustice to the Plaintiffs. The Court also dismissed ANSCI’s discretionary defences, finding that the declarations sought by the Plaintiffs had real utility and would not give rise to further disputes.

The Court made declarations that the expulsions were invalid and of no effect and that ANSCI had breached the implied Fairness Term and the Expulsion Term. The Plaintiffs were awarded costs.
