However, the applicant subsequently provided a TRA skills assessment dated 9 August 2018, confirming his Provisional Skills Assessment application was successful for the nominated occupation of Motor Mechanic (General) and could be used for a Subclass 485 visa application. The Tribunal concluded that this assessment met the requirements of clause 485.224(1).

Consequently, the Tribunal remitted the applications for Skilled (Provisional) (Class VC) visas for reconsideration by the Department, with a direction that the first applicant, Mr Jung, meets the criteria under clause 485.224(1) of Schedule 2 to the Regulations. Mrs Kim's application would be determined based on this reconsideration.
