CaseChat Overview and Summary
This matter concerned a dispute between Mr Juliet and Ms Jones regarding child support obligations for their two children. The case was heard by Judge McGuire.
The court was required to determine the total amount of registered child support liabilities owed by Mr Juliet as at 1 October 2015, and to make orders for the payment of this sum and for future child support provision. The court also needed to establish a mechanism for enforcing these payments in the event of default.
Judge McGuire declared that Mr Juliet owed $39,906.00 in registered child support liabilities as at 1 October 2015. The court ordered Mr Juliet to pay this sum to the Child Support Registrar within 14 days. Furthermore, Mr Juliet was ordered to provide a lump sum payment of $108,300.00 to Ms Jones within 28 days, to be credited against future administrative assessments of child support. This lump sum was to be credited as 100% of the total annual rate of child support from 2 October 2015 until the termination of the youngest child's assessment.
In the event of non-payment, the court made provisions for enforcement. This included the potential issuance of a Third Party Debt Notice to a purchaser of Mr Juliet's property at Property K, and if necessary, an Enforcement Warrant for the seizure and sale of Mr Juliet's property at Property T in Tasmania. Any reasonable costs incurred by Ms Jones in relation to an Enforcement Warrant were to be paid from the proceeds of sale.
