Juggeea (Migration)

The applicant, Mr Juggeea, sought review of a decision concerning a Visitor (Class FA) visa, Subclass 600 (Visitor). The review application was heard by the Tribunal.

The central legal issue before the Tribunal was whether it had jurisdiction to hear the applicant's review application, given that Mr Juggeea was not physically present within the migration zone at the time the application for review was made.

The Tribunal determined that the decision under review fell within the scope of section 338(2) of the Migration Act 1958 (Cth). Consequently, the applicant was required to be physically present in the migration zone when lodging the review application. As Mr Juggeea was outside the migration zone at the relevant time, the Tribunal concluded that the application for review was not properly made under section 347 of the Act.

Accordingly, the Tribunal held that it did not have jurisdiction to consider the matter.
