JSD Australia Pty Ltd (Migration)

The Administrative Appeals Tribunal (AAT) considered an application by JSD Australia Pty Ltd for approval of a nomination of a position under the Direct Entry nomination stream. The original decision under review was a refusal by the Department of Immigration to approve the nomination. Given the lack of evidence demonstrating that the business was actively and lawfully operating in Australia at the time of the Tribunal's decision, the Tribunal was not satisfied that the applicant met the requirements of regulation 5.19(4).

Consequently, the Tribunal affirmed the decision under review to refuse the nomination of the position.
