Jones v State of New South Wales

Jones brought proceedings against the State of New South Wales, claiming compensation for personal injuries arising from a car accident that occurred on 15 January 2010. The defendant argued that Jones's claim was statute-barred under the Limitation of Actions Act 1974 (NSW) because the proceedings were not commenced within the three-year period prescribed by the Act. The court found that the statutory period began to run on the date of the accident, 15 January 2010, and that it was not just and reasonable to permit Jones's proceedings to be brought. The court held that Jones knew or ought to have known of her injury on or about 20 January 2010, and that it would not be just and reasonable to extend the statutory period in these circumstances. The court found that a fair trial could not be had because of the significant delay in bringing the proceedings, and because of the prejudice to the defendant in having to defend the proceedings after such a long delay. The court dismissed the proceedings.

The court did not make any orders as to costs.
