CaseChat Overview and Summary
The court considered whether the agreement met the threshold criteria for approval, specifically whether it provided a safety net for employees and was not worse off overall. The agreement's provisions on pay rates, penalty rates, and other conditions were closely examined. The Commission assessed whether the agreement offered fair and reasonable terms and conditions, considering the views of both parties and the broader implications for the industry.
In its decision, the Fair Work Commission found that the PRW Agreement 2016 met the necessary criteria for approval. The agreement provided a safety net for employees by ensuring that their terms and conditions were at least as favourable as the applicable award or registered agreement. The Commission also noted that the agreement was not worse off overall and contained provisions that were fair and reasonable. Consequently, the Commission approved the agreement, subject to certain conditions.
