The court found that the article, when read as a whole by an ordinary reasonable reader, was not capable of bearing the defamatory meanings alleged by Mr O'Shane. The defence of contextual truth was therefore not considered necessary to determine.

The appeal was allowed, and the judgment of the Full Federal Court in favour of Mr O'Shane was set aside.
