CaseChat Overview and Summary
The central legal issue was whether the enterprise agreement complied with the procedural and substantive requirements for registration. Specifically, the Commission needed to ensure that the agreement was made in good faith and that it contained the necessary minimum terms and conditions, including those relating to minimum wages and entitlements. Furthermore, the Commission had to consider whether the agreement was consistent with the Fair Work (Registered Organisations) Act 2009, which mandates that registered organisations must be independent of employers.
The Commission found that the agreement was made in good faith and contained all the necessary minimum terms and conditions. It was also consistent with the requirements of the Fair Work (Registered Organisations) Act 2009. The CFMEU was deemed to be an independent organisation, as it had not been shown to be unduly influenced by JMFM Construction. Consequently, the Commission approved the registration of the JMFM Construction Pty Ltd Enterprise Agreement 2013-2017.
