The case of *Jindal and Jindal* concerned parenting and property division between a husband and wife. The primary dispute revolved around the future living arrangements and parental responsibility for their child, X, and the equitable distribution of their assets, particularly a property identified as Property C.

The court was required to determine the best interests of the child, X, in relation to parental responsibility and living arrangements. Additionally, the court had to decide on the appropriate financial settlement between the parties, including the division of property and the discharge of any encumbrances on the real property.

The court ordered that the husband have sole parental responsibility for child X, with the child to live with the husband and spend time and communicate with the wife as agreed with the husband. In relation to property, the husband was ordered to pay the wife $48,600 by a specified date. If the full payment was not made by that date, the parties were to sell Property C, with the proceeds applied first to sale costs, then to discharge any mortgage or encumbrances, then to satisfy the outstanding payment to the wife with interest at 7.5% per annum, and finally, any balance to the husband. Each party was otherwise to retain sole entitlement to their respective superannuation and other property as at the date of the orders, with each party liable for their own liabilities.
