The Administrative Appeals Tribunal considered an appeal by an applicant for a Partner (Temporary) (Class UK) visa, subclass 820. The applicant sought review of a decision made by the Department of Immigration. It emphasised that regard must be had to all circumstances, including the specific matters listed in regulation 1.15A(3), which are to be answered as questions, citing He v MIBP [2017] FCAFC 206. The Tribunal considered the evidence provided by both parties, including documents submitted to the Department and additional information presented at the hearing.

Ultimately, the Tribunal concluded that the matter should be remitted for reconsideration. This indicates that the Tribunal found that the evidence and the assessment of the relationship against the statutory criteria required further examination.
