The parties to this matter were a husband and wife, and the dispute concerned the wife's costs of and incidental to a trial that took place on 2, 3, and 4 December 2019. The application before the court was specifically in relation to these costs. The decision was made by Foster J.

The primary legal issue before the court was to determine the quantum and allocation of the wife's costs of the trial, and her costs associated with the subsequent costs application. This involved considering the period from which the costs were to be awarded, specifically from 19 November 2019.

Foster J ordered that the husband pay the wife's costs of and incidental to the trial held on 2, 3, and 4 December 2019, commencing from 19 November 2019. Additionally, the husband was ordered to pay the wife's costs of and incidental to the costs application itself. These costs were to be agreed upon by the parties within one month, or otherwise assessed by the court.
