The Administrative Appeals Tribunal considered an application for a Student (Temporary) (Class TU) visa (Subclass 500). The applicant sought review of a decision concerning their eligibility for the visa.

The primary legal issue before the Tribunal was whether the applicant had satisfied the requirements for the Subclass 500.211 visa, specifically concerning the provision of a Confirmation of Enrolment (COE) and evidence of tuition fee payment.

The Tribunal was satisfied that the applicant had met the relevant criteria upon receiving a copy of a COE for a Diploma of Human Resources Management, valid from 12 March 2018 to 10 March 2019. Furthermore, evidence of a part payment of tuition fees, specifically $1,000 out of $6,000, valid until 31 March 2018, was accepted by the Tribunal. Based on this new evidence, the Tribunal concluded that the matter should be remitted for reconsideration. The Tribunal remitted the application for reconsideration with a direction that the applicant meets the criteria for a Subclass 500.211 visa, specifically clause 500.211(a) of Schedule 2 to the Regulations.
