Jacques and Jacques

In the matter of *Jacques and Jacques*, heard before Judge Phipps, the applicant sought enforcement of an earlier Federal Circuit Court order made on 30 October 2015. The dispute concerned the outstanding balance of $44,000 owed by the respondent to the applicant pursuant to that order, as well as the respondent's obligation to remove a caveat lodged over a property.

The court was required to determine whether the respondent had discharged their obligation to pay the outstanding sum and to clarify the conditions under which the applicant was obliged to remove the caveat. The court also considered the applicant's entitlement to seek enforcement of the outstanding debt and associated costs.

Judge Phipps reasoned that the respondent had failed to pay the outstanding amount of $44,000 as required by the October 2015 order. Consequently, the court ordered the respondent to pay this sum, along with interest at a rate of 8% from 29 November 2015 until the date of payment. The court further clarified that the applicant's obligation to remove the caveat was limited to the terms stipulated in paragraph 27 of the October order. The court also ordered the respondent to pay the applicant's costs, fixed at $4,312, and confirmed the applicant's right to seek an enforcement warrant for the payment of the principal sum, interest, and costs.
