| DEPUTY PRESIDENT BOYCE | SYDNEY, 24 JUNE 2022 |
Application for approval of the Global Express Fleet & Equipment Services Karawatha Enterprise Agreement 2022
An application has been made for approval of an enterprise agreement to be known as the Global Express Fleet & Equipment Services Karawatha Enterprise Agreement 2022 (Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (Act). It has been made by IPEC Pty Ltd (Employer). The Agreement is a single enterprise agreement.
Undertakings
The Employer has provided written undertakings dated 23 June 2022. Those undertakings are attached at Annexure A to this decision and become terms of the Agreement. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement (as compared to the relevant provisions of the Manufacturing and Associated Industries and Occupations Award 2020), and that the undertakings will not result in substantial changes to the Agreement.
Coverage of employee organisation(s)
The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU), being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants to be covered by the Agreement. In accordance with s.201(2) of the Act, I note that the Agreement covers this organisation.
Model consultation term
Pursuant to s.205(2) of the Act, the model consultation term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.
Conclusion
Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 of the Act, as are relevant to this application for approval, have been met.
I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 1 July 2022. The nominal expiry date of the Agreement is 30 June 2024.

CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement was "not contrary to public policy", provided for "no unlawful content", and "no unfair content". This involved assessing the fairness of the agreement's terms and conditions, ensuring there was no content that contravened any statutory minimum entitlements or protections, and that the agreement adhered to procedural fairness in its creation and negotiation. The Commission had to examine the evidence presented on the bargaining process, the content of the agreement, and any submissions from the parties involved.
After considering the submissions and evidence, the Fair Work Commission determined that the agreement was fair and met all the necessary criteria. The Commission found that the agreement was not contrary to public policy, contained no unlawful content, and no unfair content. The bargaining process was deemed fair, and the terms and conditions of the agreement were found to be reasonable and in line with the statutory minimum standards. Consequently, the Commission approved the Global Express Fleet & Equipment Services Karawatha Enterprise Agreement 2022.
The Commission's final order was to approve the enterprise agreement, confirming its validity and legality under the Fair Work Act 2009. This approval meant that the terms and conditions set out in the agreement would apply to the employees in the Karawatha region as of the specified commencement date, ensuring that both the employer and employees were bound by the agreed terms.
