The Administrative Appeals Tribunal (AAT) considered an application for review concerning a Partner (Temporary) (Class UK) visa. The applicant, Inggoi, sought review of a decision, but the application for review was lodged with the Tribunal after the statutory time limit had expired.

The central legal issue before the Tribunal was whether it possessed jurisdiction to hear the application for review, given that it was lodged out of time. The Tribunal was required to determine if the applicant had complied with the legislative requirements for lodging an application for review.

Senior Member Ann Duffield reasoned that the application for review was received by the Tribunal on 10 February 2020. Consequently, the Tribunal found that it lacked jurisdiction to consider the merits of the matter.

The Tribunal ordered that it did not have jurisdiction in this matter.
