COMMISSIONER BOOTH | BRISBANE, 24 APRIL 2014 |
Application for approval of the Hymba Yumba Community Hub Collective Agreement 2013.
[1] An application has been made for approval of a single enterprise agreement known as the Hymba Yumba Community Hub Collective Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Independent Education Union of Australia.
[2] On the basis of the material before me, I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.
[3] As the consultation term does not meet the requirements of s.205 of the Act, the model consultation term is taken to be a term of the Agreement and is attached to the Agreement.
[4] The Independent Education Union of Australia, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[5] The Agreement is approved and, in accordance with s.54, will operate from 1 May 2014. The nominal expiry date of the Agreement is 30 June 2016.

CaseChat Overview and Summary
The legal issues that the Commission had to resolve included whether the agreement met the requirements for approval under the Fair Work Act, and whether the agreement provided for the minimum entitlements as stipulated by the Act. A particular point of contention was whether the proposed agreement adequately covered the minimum wages and conditions for the workers involved, in line with the relevant award and the statutory minimum standards.
In delivering its decision, the Commission carefully considered the provisions of the Fair Work Act and the terms of the proposed agreement. The Commission noted that the agreement provided for wages and conditions that were no less favourable than those specified in the relevant award, and also included certain additional benefits. The Commission found that the agreement complied with the requirements for approval, as it provided for minimum entitlements and did not disadvantage the workers. Consequently, the Commission approved the Hymba Yumba Community Hub Collective Agreement 2013, recognising its compliance with the statutory framework.
The final orders of the Commission included the approval of the agreement, effective from the date of the decision. The Commission also noted that any disputes arising from the operation of the agreement would be subject to the processes outlined within the agreement and the Fair Work Act. This decision provided clarity and certainty for the parties involved, ensuring that the terms of the agreement were legally sound and enforceable.
