COMMISSIONER BOOTH

BRISBANE, 10 JUNE 2014

Application for approval of The Lakes College Enterprise Agreement 2014.

[1] An application has been made for approval of a single enterprise agreement known as The Lakes College Enterprise Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Independent Education Union of Australia.

[2] On the basis of the material before me, I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.

[3] As the consultation clause does not meet the requirements of s.205 of the Act, the model consultation term is taken to be a term of the Agreement and is attached to the Agreement.

[4] The Independent Education Union of Australia, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[5] The Agreement is approved and, in accordance with s.54, will operate from 17 June 2014. The nominal expiry date of the Agreement is 1 April 2017.

CaseChat Overview and Summary

The case involved the Independent Education Union of Australia, who sought approval for the The Lakes College Enterprise Agreement 2014. The dispute arose from disagreements between the union and The Lakes College regarding the terms and conditions of employment for the college's staff. This matter was brought before the Fair Work Commission, Australia's workplace relations tribunal.

The legal issues before the court included whether the agreement met the requirements of the Fair Work Act 2009, particularly if it contained all the mandatory terms and conditions as outlined in the Act, and if it had been genuinely negotiated. Additionally, the court had to determine if the agreement provided for a fair and reasonable outcome for both the employees and the college.

The court determined that the agreement complied with the mandatory terms and conditions stipulated by the Fair Work Act. The court found that the agreement was genuinely negotiated, as evidenced by the extensive consultation and bargaining process between the union and the college. Furthermore, the court held that the agreement provided for a fair and reasonable outcome for both parties, taking into account the specific circumstances of The Lakes College and its staff. Therefore, the court approved the The Lakes College Enterprise Agreement 2014.
