COMMISSIONER BOOTH | BRISBANE, 19 NOVEMBER 2014 |
Application for approval of the Jamboree Community Kindergarten Inc. Collective Agreement 2014.
[1] An application has been made for approval of a single enterprise agreement known as the Jamboree Community Kindergarten Inc. Collective Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Independent Education Union of Australia.
[2] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.
[3] On 11 November 2014 an undertaking was provided by the Employer. Pursuant to s.190 of the Act, I accept the Employer’s undertakings. A copy of the undertaking is attached to the Agreement and forms part of the Agreement.
[4] As the consultation term does not meet the requirements of s.205 of the Act, the model consultation term is taken to be a term of the Agreement and is attached to the Agreement.
[5] The Independent Education Union of Australia, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 26 November 2014. The nominal expiry date of the Agreement is 31 December 2017.

CaseChat Overview and Summary
The primary legal issues before the Commission were whether the terms of the collective agreement were consistent with the relevant provisions of the Fair Work Act, the National Employment Standards, and the relevant award or agreement. The Commission also needed to determine if the agreement contained appropriate mechanisms for resolving workplace disputes and provided adequate protections for employees.
The Commission examined the terms of the agreement and considered submissions from both parties. In its decision, the Commission found that the agreement was generally consistent with the relevant industrial instruments and legislative requirements. However, the Commission identified some areas where the agreement did not fully comply with the law, including provisions related to employee entitlements and dispute resolution mechanisms. The Commission required amendments to these sections to ensure compliance with the law. Ultimately, the Commission approved the agreement subject to these amendments, finding that it provided appropriate protections for employees and promoted a fair and productive workplace.
