CaseChat Overview and Summary

The applicant, I&C Instrumentation & Electrical Pty Ltd, sought approval of an Enterprise Agreement from the Fair Work Commission. The applicant is an electrical contracting company, and the dispute concerns the terms and conditions of employment for its employees. The matter was heard and determined by the Fair Work Commission, an independent statutory tribunal established under the Fair Work Act 2009 (Cth).

The central legal issue before the Commission was whether the Enterprise Agreement in question complied with the requirements of the Fair Work Act and the Fair Work Regulations. Specifically, the Commission needed to determine if the agreement provided for fair and reasonable terms and conditions of employment, and whether it was made in accordance with the procedural requirements of the Act. The applicant argued that the agreement was fair and reasonable and that all necessary procedures were followed.

In its decision, the Commission found that the agreement was fair and reasonable in all its terms. The Commission noted that the agreement contained provisions for wages, hours of work, leave entitlements, and other conditions of employment that were consistent with industry standards and practices. The Commission also found that the applicant had followed all necessary procedural requirements in making the agreement, including providing employees with sufficient information about the agreement and giving them an opportunity to vote on it. The Commission concluded that the agreement met all the legal requirements and approved it accordingly.

The Fair Work Commission approved the I&C Instrumentation & Electrical Pty Ltd Enterprise Agreement 2016 - 2017. The agreement will now provide the terms and conditions of employment for the applicant's employees for the specified period. The applicant is bound by the terms of the agreement, and its employees are entitled to the benefits and protections it provides. The decision of the Commission is final and binding, and may not be challenged in any court or tribunal.
