Consequently, the Tribunal found that the nominated position met the requirements of cl.186.223. Furthermore, the Tribunal determined that the secondary applicants, who applied as members of the primary applicant's family unit and were included in the approved nomination, satisfied the criteria under reg.186.312.

Given these findings, the Tribunal concluded that the appropriate course of action was to remit the visa application to the Minister for reconsideration of the remaining criteria. The Tribunal directed that the first named applicant met the criteria under cl.186.223 of Schedule 2 to the Regulations.
