The Administrative Appeals Tribunal considered an application for an Employer Nomination Scheme (Class EN) visa, subclass 186. The applicants were Ms Ying Huang, Mr Yaxiong Yao, and Mr Dongyu Yao. The Tribunal affirmed the decision to refuse the visa application of Mr Dongyu Yao.

The primary legal issue before the Tribunal was whether Mr Dongyu Yao met the criteria for the subclass 186 visa, specifically in relation to his status as a remaining member of a family unit and the requirement for a combined application with a family member who satisfied the primary criteria.

The Tribunal reasoned that Mr Dongyu Yao did not meet the criteria in clause 186.311 of the Migration Regulations. This was because there was no member of his family unit who satisfied the primary criteria for the visa with whom he had made a combined application. Consequently, the Tribunal affirmed the decision to refuse his visa application. The Tribunal also found that it did not have jurisdiction in relation to the applications of Ms Ying Huang and Mr Yaxiong Yao.
