HUA & JIANG

In the matter of HUA & JIANG, heard by Judge Newbrun, the dispute concerned parenting arrangements for a child, X, born in 2006, and involved an application for injunctive relief for the personal protection of X and the Mother.

The court was required to determine the living arrangements for X, the nature of X's time with the Father, and whether injunctive orders were necessary for the protection of X and the Mother. Additionally, the court needed to consider the preparation of a Family Report to assist in determining the best interests of the child.

The court ordered that X shall live with the Mother and spend time with the Father in accordance with X's expressed views, with both parents to facilitate such time. Crucially, pursuant to sections 68B(a) and 68B(b)(i) of the *Family Law Act 1975* (Cth), the court granted an injunction restraining the Father from approaching or contacting the Mother and Child except as agreed in writing, entering specified locations related to X's schooling and extracurricular activities, and from assaulting, molesting, harassing, threatening, or stalking X. Furthermore, pursuant to section 62G(2) of the Act, the parties and X were ordered to attend upon a Family Consultant for the preparation of a Family Report addressing various aspects of the child's welfare and the parents' capacities. The proceedings were adjourned pending the release of this report.
