Consequently, the Tribunal set aside the decision under review and substituted a decision not to cancel the applicant's Subclass 187 visa. The Tribunal noted that this decision was made marginally in the applicant's favour, acknowledging the seriousness of the breach of sections 101(b) and 103 of the Act.
