This involved assessing the extent of her hearing loss in relation to the scheme's guidelines and considering whether her reported pain symptoms and degenerative changes were disabling to the claimed extent.

The Tribunal found that while HKTR experienced widespread pain and had some degenerative changes and bursitis, these were not considered disabling to the extent claimed. Regarding her hearing loss, the Tribunal noted that HKTR did not habitually use assistive technology, such as a hearing aid, and her use of an iPhone and headphones did not qualify as such. The evidence indicated she could communicate independently with her healthcare team and family, understanding and being understood, which aligned with the scheme's guidelines. The measured hearing loss in her better ear was below the threshold specified in the guidelines, and there was no evidence to suggest her impairment met the required threshold for communication. While acknowledging HKTR had a truncated social life, the Tribunal concluded that the available material did not support her contention that the lifetime support requirement was satisfied.

Consequently, the Tribunal affirmed the decision under review, finding that HKTR did not meet the early access requirements for the National Disability Insurance Scheme.
