CaseChat Overview and Summary
The primary legal issue before the Commission was whether the agreement complied with the provisions of the Fair Work Act and the process outlined for approval of enterprise agreements. Specifically, the Commission needed to consider whether the agreement had been fairly negotiated and whether it provided for terms and conditions that were better off overall for the employees. The Commission also needed to ensure that the agreement did not undermine the protection of the safety, health and welfare of employees.
In its decision, the Commission found that the agreement had been fairly negotiated and provided for terms and conditions that were better off overall for the employees. The Commission noted that the agreement included provisions for the safety, health and welfare of employees, and that it did not undermine the protection of employees. The Commission was satisfied that the agreement met the requirements of the Act and was in the best interests of the employees. The Commission approved the agreement, and it will now apply to all employees of Higgins Coatings Pty Ltd in Victoria for the period of 2021-2024.
