Hicks purchased a restaurant from the Tarantos in February 1989. He brought an action against the Tarantos and Blackwell Appleyard, their solicitors, for misrepresentation and breach of warranty. The action against the Tarantos failed. Hicks then engaged Stewart, a solicitor, to act for him in the action against Blackwell Appleyard. Hicks sued Stewart for professional negligence. Stewart was found to be liable for professional negligence for failing to properly prepare the action for trial, for failing to obtain evidence which would have assisted Hicks, and for giving negligent advice. Hicks was awarded damages of $30,344.00.
