CaseChat Overview and Summary
This matter concerned an application by HI-TEK FITTINGS PTY LTD for the approval of a nomination for a position as a Café or Restaurant Manager. The nominee, Valentina Strambaci, had previously held a Subclass 457 visa in the same occupation. The Administrative Appeals Tribunal was required to determine whether the applicant met the requirements for approval of the nomination under the Temporary Residence Transition stream, as set out in regulation 5.19(3) of the Migration Regulations 1994.
The Tribunal was tasked with assessing whether the application for approval was compliant, including being in the approved form, accompanied by the prescribed fee, and identifying a relevant person and occupation. It also needed to consider the status of the nominator, specifically whether it was a standard business sponsor actively and lawfully operating a business in Australia and had not met certain exclusionary criteria in its most recent sponsorship approval. Furthermore, the Tribunal had to examine whether the nominee met the employment and visa holding requirements, and whether the proposed employment conditions were favourable and met training commitments.
In its reasoning, the Tribunal found that the application was made in the approved form, with the prescribed fee, and correctly identified the nominee and her occupation as Café or Restaurant Manager, which matched the occupation held under her Subclass 457 visa. The Tribunal was satisfied that the nominator was actively and lawfully operating a restaurant business and met the criteria regarding its sponsorship history. Crucially, the Tribunal was satisfied that the nominee had met the requirements for holding Subclass 457 visas and being employed in the nominated occupation for the requisite periods, that the employment was full-time and undertaken in Australia, and that the proposed terms and conditions of employment were no less favourable than those offered to Australian citizens or permanent residents. The Tribunal also found that the nominator had committed to and fulfilled its training requirements.
Consequently, the Tribunal set aside the original decision and substituted a decision approving the nomination.
