Herman and Nubis

In the matter of *Herman and Nubis*, heard by Rose J, the husband had filed an Application in a Case on 2 December 2008. The wife subsequently made an oral application for costs against the husband.

The court was required to determine whether to grant the husband's application and whether to order costs against the husband in favour of the wife.

Rose J dismissed the husband's application. Furthermore, the court dismissed the wife's oral application for an order for costs against the husband. The parties had reached an agreement regarding the implementation of the Slip Rule, and a minute of proposed consent orders had been prepared by counsel for the wife.
