Henderson v Bakharia

In Henderson v Bakharia, the dispute was between the plaintiff, Henderson, and the defendant, Bakharia, and was heard in the Supreme Court of Queensland. The plaintiff, Henderson, filed a claim against Bakharia, alleging negligence and breach of contract. The defendant, Bakharia, applied to have the action struck out on the basis that the statement of claim was substantially incomprehensible and did not disclose a reasonable cause of action. The central legal issue before the court was whether the statement of claim was sufficiently clear and comprehensible to allow the case to proceed. The court made an order that the action be struck out, and the plaintiff was given the opportunity to file an amended statement of claim within a specified time frame. However, if the plaintiff failed to file an amended statement of claim that met the requirements of the rules of court, the action would be permanently dismissed.
