CaseChat Overview and Summary

Hazell Bros Group Pty Limited, trading as Hazell Bros, applied to the Fair Work Commission for the approval of the Hazell Bros Group Pty Limited Civil Construction Employees Tasmania and CFMEU Enterprise Agreement 2014-2017. The dispute involved the terms and conditions of employment for civil construction employees in Tasmania, as negotiated between the employer and the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU). The Fair Work Commission was tasked with determining whether the proposed enterprise agreement complied with the Fair Work Act 2009 and should be certified as a registered agreement.

The primary legal issues before the Commission were whether the agreement met the statutory requirements for approval, including provisions for minimum wages and conditions, employee protections, and the process by which the agreement was negotiated and finalised. The Commission examined the bargaining process, the fairness of the terms, and whether the agreement provided for the mandatory rights of employees as outlined in the Fair Work Act.

After thorough examination, the Fair Work Commission found that the enterprise agreement met all statutory requirements and was fair and reasonable in all its terms. The Commission noted that the agreement had been negotiated in good faith, provided for the mandatory rights of employees, and included provisions that were not less favourable than the applicable awards or the national employment standards. The Commission certified the agreement as a registered enterprise agreement, effective from the date of the approval decision.

The Commission's final order was the certification of the Hazell Bros Group Pty Limited Civil Construction Employees Tasmania and CFMEU Enterprise Agreement 2014-2017 as a registered agreement, effective from the date of the decision. This certification ensures that the terms of the agreement are binding on the parties and enforceable under the Fair Work Act.
