A majority of the High Court (Rich A.C.J., Starke and Williams JJ.) held that while a maintenance deed did not oust the court's jurisdiction under the Act, the evidence as a whole did not establish wilful neglect. They reasoned that the deed was negotiated at arm's length between parties with legal representation, and the wife had initially accepted its terms. The court found that the husband's adherence to the deed, coupled with the wife's own income and the circumstances surrounding the deed's execution, meant that his omission to pay more than the deed stipulated did not constitute wilful neglect. The presumption of wilful neglect under section 11 of the Act was therefore rebutted.

Consequently, the High Court allowed the appeal, discharging the orders made by the justices and the Supreme Court of Western Australia. The court expressed a hope that the husband would address the condition of the matrimonial home, suggesting its sale and the acquisition of a more suitable property.
