The court further found that the worker was entitled to a reassessment of his permanent impairment assessment as the employer's notification to the worker regarding compensation for the psychiatric injury was unqualified, leaving no rights or privileges for the employer to preserve.

The court ordered that the worker's claim for reassessment of his permanent impairment assessment should proceed, and the employer's assessment of the worker's whole person impairment for the secondary psychiatric injury was upheld.
