CaseChat Overview and Summary
This matter concerned an appeal by Mr and Mrs Harris against a decision by the Secretary of the Department of Social Services that they had been overpaid Newstart allowance. Mrs Harris was granted the allowance in May 2013 and was employed casually by Mission Australia until November 2014, after which she commenced full-time employment. Mr Harris was granted Newstart allowance in December 2013 and was employed casually as a driver until November 2014. Both parties received notices from Centrelink detailing their reporting obligations regarding earnings. Following a review, a delegate of the Secretary determined that Mr and Mrs Harris had incurred debts totalling $8,378.68 and $8,743.39 respectively, due to overpayments of Newstart allowance. The appeal was heard by Mr S. Webb, Member.
The primary legal issues before the Member were whether the calculations of the overpayments of Newstart allowance made by the Secretary were correct, and consequently, whether the debts raised against Mr and Mrs Harris were valid and accurately quantified. This involved determining the correct application of the relevant legislative formulae and income test provisions to the varying fortnightly earnings of both Mr and Mrs Harris during their periods of employment and receipt of the allowance. The Member was required to consider the information reported by the Harrises to Centrelink and whether this accurately reflected their gross earnings before tax and other deductions.
The Member acknowledged the complexity of the legislative provisions governing Newstart allowance calculations and income reporting, noting that a lack of understanding by recipients does not invalidate the correct application of these provisions. After reviewing the evidence, including Centrelink notices and income reporting records, the Member found that while the recalculation of Mr Harris's debt was correct, the recalculation of Mrs Harris's overpayment debt was not. The Member concluded that the correct amount of Mrs Harris's overpayment debt was $8,177.64.
Consequently, the Member affirmed the decision in relation to Mr Harris's debt. However, the decision in relation to Mrs Harris's debt was varied, reducing the amount of her overpayment debt to $8,177.64.
