CaseChat Overview and Summary
The primary legal issues before the Commission were whether the proposed agreement provided for the proper management and operation of the enterprise, and whether it complied with the relevant provisions of the Fair Work Act 2009. The Commission considered whether the agreement adequately provided for the determination of employment terms and conditions, and whether it complied with the good faith bargaining requirements.
The Commission found that the proposed agreement provided for the proper management and operation of the enterprise, and that it complied with the statutory requirements. The Commission noted that the agreement provided for the determination of terms and conditions of employment, including wages, hours of work, and other conditions such as leave and dispute resolution. The Commission also found that the agreement had been negotiated in good faith and that the parties had made a genuine attempt to reach an agreement.
