Consequently, the Tribunal concluded that the nominated position met the requirements of clause 186.233, including the absence of adverse information and its continued availability.

Given these findings, the Tribunal remitted the visa applications to the Minister for reconsideration, with a direction that the first named applicant had met the criteria under clause 186.233 of Schedule 2 to the Regulations. The Minister was to consider the remaining criteria for the grant of the visas.
