Hamm and Hamm & Ors

In proceedings between Ms Hamm (the wife) and Mr Hamm (the husband), concerning outstanding property settlement, the wife sought to join Mr A Hamm, Ms B Hamm, and C Pty Ltd as third parties. The wife alleged that she and the husband held a beneficial interest in property owned by these proposed third parties, and sought to establish grounds for the imposition of a constructive trust over that property.

Consequently, the court ordered that Mr A Hamm, Ms B Hamm, and C Pty Ltd be joined as respondents to the proceedings. However, the wife's Amended Application in a Case filed on 12 February 2010 was otherwise dismissed.
