CaseChat Overview and Summary

This case involved property proceedings between Mr. Haddock (the applicant husband) and Mrs. Haddock (the respondent wife) before the Family Court of Australia at Sydney. The central dispute concerned the division of the parties' former matrimonial home and other assets. The husband sought an order for the sale of the home with proceeds distributed 87% to him and 13% to the wife, with other property retained by each party. The wife also sought the sale of the home but proposed an equal division of the net proceeds, reflecting a significant difference in their desired outcomes.

The court was required to determine the just and equitable distribution of the parties' property under section 79 of the *Family Law Act 1975*. This involved identifying and valuing the parties' assets and liabilities, assessing their respective contributions to the marriage, and considering other relevant factors under section 75(2) of the Act. Key issues included the wife's substantial inheritance received late in the marriage and its impact on the property division, as well as allegations of non-disclosure by the husband regarding his interests in family trusts.

Judicial Registrar Johnston applied a four-step approach, assessing contributions and then adjusting for other factors. He found that while both parties contributed financially and domestically, the wife's significant inheritance, received late in the marriage, fundamentally altered the property pool. He determined that the wife's contributions, including her inheritance and greater role as primary caregiver, were three times that of the husband, leading to an initial assessment of 75% for the wife and 25% for the husband. However, considering section 75(2) factors, particularly the significant imbalance in property distribution and the husband's potential future responsibilities, the court ordered a 5% adjustment in his favour. This resulted in a final division of 70% of the available property to the wife and 30% to the husband.

The court ordered the sale of the former matrimonial home by private treaty, with provisions for a public auction if private sale failed within three months. The proceeds were to be disbursed after sale costs, with 60.95% allocated to the husband and 39.05% to the wife. The wife was granted exclusive occupation of the home pending sale and was responsible for outgoings. All other property and financial resources were to be retained by the parties respectively. The Registrar was appointed to execute documents if necessary, and the orders were to commence operation on 8 August 2007.
