Gyory and Secretary, Department of Social Services (Social services second review) [2024] AATA 67 [2024] AATA 67 25 January 2024

CaseChat Overview and Summary

Dr Gyory applied to the Administrative Appeals Tribunal (AAT) for a second review of decisions made by the Secretary of the Department of Social Services concerning his claims for special benefit and the suspension of his Jobseeker Payment. The Respondent sought to have Dr Gyory's applications dismissed. The matter came before D. J. Morris SM.

The legal issues before the Tribunal were whether the applications for second review were frivolous, vexatious, misconceived, lacking in substance, had no reasonable prospect of success, or otherwise constituted an abuse of process, pursuant to section 42B of the AAT Act. Additionally, the Tribunal considered Dr Gyory's request for a stay of proceedings, which related to issues beyond the scope of the reviewable decisions.

The Tribunal reasoned that Dr Gyory conceded the First Review decisions were correct and that his applications for a stay were not directed at the reviewable decisions but rather at broader administrative actions and his relationship with his employment service provider. The Tribunal noted that it lacked jurisdiction to make orders concerning the operational conduct of government agencies or departments. Furthermore, the Tribunal found that a stay order would have no practical utility in either case: staying a rejection of a special benefit claim does not grant the benefit, and staying a decision that affirmed the restoration of a short-term suspension of Jobseeker Payment would have no effect as the payment was already restored.

Consequently, the Tribunal dismissed Dr Gyory's applications as misconceived and an abuse of process, and refused the request for a stay as it was rendered nugatory by the dismissal of the applications.
