Gwynne & Campos

In the matter of PAC 2660 of 2021, Ms Gwynne (the Mother) sought a recovery order against Ms Campos (the Maternal Grandmother) concerning the child, X, born in 2017. The proceedings were heard by Judge Newbrun.

The court was required to determine whether to grant the Mother's application for a recovery order and to make interim parenting orders in the best interests of the child.

Judge Newbrun ordered that the maternal grandmother return the child to the Mother's primary care on 28 May 2021. The court further ordered that the child live with the Mother and that the Mother not engage in sexualised behaviour in the child's presence. The child was to spend time with the maternal grandmother as agreed in writing between them. An independent children's lawyer was appointed to represent the child, and leave was granted for the parties and the independent children's lawyer to issue more than five subpoenas for document production. The proceedings were listed for mention on 4 August 2021, with the independent children's lawyer requested to attend.
