Furthermore, there was no adverse information known to the Department, and the nominator had a satisfactory record of compliance with workplace relations laws. Regarding the specific requirements for regional nominations, the Tribunal was satisfied that there was a genuine need for a skilled Painting Trades Worker, that the applicant had advertised the position and was unable to find a suitable local candidate, and that the tasks of the nominated position corresponded to the occupation of Painting Trades Worker.

Accordingly, the Tribunal set aside the original decision and substituted a decision approving the nomination.
