CaseChat Overview and Summary

This matter concerned an application for a Subclass 500 (Student) visa by Gupreet Singh. The applicant had declared he held a Confirmation of Enrolment (COE) but did not provide this or any other proof of enrolment or tuition fee payment to the Department. The delegate refused the visa on the grounds that the applicant failed to provide adequate evidence of genuine access to funds (GAF). The Administrative Appeals Tribunal was required to determine whether the applicant had provided sufficient evidence of financial capacity in accordance with the relevant legislative instrument.

The Tribunal considered the requirements for evidence of financial capacity as set out in cl.500.214(3) of the Migration Regulations 1994 and LIN 19/198, the Financial Capacity Instrument. A COE, or other proof of enrolment, is critical as it provides details of course fees, which are an element of financial capacity. The applicant had failed to provide a COE or any other documentation to verify his declaration of enrolment. The Tribunal noted that an applicant is required to provide current information to satisfy the GAF criteria.

The Tribunal invited the applicant to provide documents to establish he met the visa criteria, specifically requesting a current COE or other proof of enrolment, documents relating to past studies, and evidence of genuine access to sufficient funds to cover course fees, living costs, and travel expenses. Despite this invitation, the applicant did not provide the necessary documentation. Consequently, the Tribunal found that the applicant had not met the criteria for the grant of a Subclass 500 (Student) visa. The decision under review, which affirmed the refusal of the visa, was therefore affirmed.
