The court ordered that Gunnedah Shire Council, in the interests of StateCover Mutual, must pay for the reasonable medical expenses incurred by Mr Brookes in the treatment of his injury. Additionally, the court ordered that Gunnedah Shire Council, in the interests of StateCover Mutual, must pay the costs of the appeal, as well as the costs of the Arbitrator's decision. The decision of the Arbitrator was thus overturned, and the court's ruling took its place, providing clarity on the deemed date of injury in cases of aggravated pre-existing conditions.
