Gunawan (Migration)

The Administrative Appeals Tribunal considered an application for review by Mr. Gunawan concerning a decision made under the *Migration Act 1958* (Cth). The applicant sought to lodge a review application for a Bridging A (Class WA) visa, Subclass 010, but the application was lodged outside the prescribed time limit.

The central legal issue before the Tribunal was whether the applicant's application for review had been lodged within the time permitted by the relevant legislation. This required the Tribunal to determine the date on which Mr. Gunawan was deemed to have been notified of the original decision, as this date established the commencement of the period for lodging a review application.

The Tribunal found that, pursuant to section 494C of the *Migration Act 1958* (Cth), Mr. Gunawan was taken to have been notified of the decision on 22 January 2018. Consequently, the prescribed period for lodging an application for review expired on 12 February 2018. As the application was not received by the Tribunal until 19 February 2018, it was lodged out of time. The Tribunal concluded that it therefore lacked jurisdiction to consider the merits of the application.
